TERMS AND CONDITIONS

 

The website 'Fun Malaysia' (www.funmalaysia.my) is operated by the company Longbow Destination Connect Sdn Bhd. Please read these Terms & Conditions accordingly. By booking or purchasing tickets through Fun Malaysia platform, you agree to these Terms & Conditions on behalf of yourself and all persons named in your booking.

1.0    Definitions

·         "Agency," "We," "Us," "Our" refers to Fun Malaysia.

·         “Service Provider” are the including but not limited to Theme Parks, other related travel or services provider, or Fun Malaysia affiliated partner(s) for which locations for which you buy the tickets.

·         "Client," "You," "Your" refers to the person(s) making a booking through Fun Malaysia and all persons named in the booking.

 

2.0    Agency Role and Responsibility

Fun Malaysia platform acts as a platform or sale channel for Service Provider to sell their park tickets and does not own, operate, manage, or control the Service Provider tickets or services.

·         We act as an intermediary, enabling you to book service provider’s tickets through our website and arranging the contracts between you and the park operators. While we take care in processing your bookings, we do not control the operations of the Service Provider themselves.

·         Your rights and remedies are governed by the terms and conditions of the respective service provider. The event of a conflict, the Service Provider’s terms and conditions shall prevail.

·         We are not responsible for the acts, omissions, defaults, negligence, financial default, or failure to honor a booking by any Service Provider. We are not liable for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity caused by any Service Provider or other third party.

3.0    Booking and Document Accuracy

·         It is the Client's sole responsibility to immediately review all aspects of the Booking confirmation (e.g., tickets) upon receipt to verify that all names, dates, times and prices are correct.

·         The name, phone number and email address must be accurate on your ticket and booking. You must notify the service provider immediately of any discrepancies.

·         The Client voluntarily assumes full responsibility for any and all risks and/or costs involved with the failure to report errors or omissions, including any re-ticketing, change, or cancellation fees imposed by the Service Provider or a non-refundable service fee.

 

4.0    Pricing, Payments, and Confirmation

  • All prices and fares quoted are subject to availability and are not guaranteed until the Booking is confirmed and full payment is received. Prices may change due to fluctuations in currency exchange rates, government action (e.g., increased taxes), or other Service Provider-imposed increases.
  • A Booking is confirmed when the system (Fun Malaysia) issues a written confirmation and the applicable of full payment has been processed and accepted by merchant’s system (Fiuu Payment Gateway).
  • Failure to make the final payment or any violation or cancellation from the system (Fun Malaysia) may result in the automatic cancellation of your Booking, denial of service, and forfeiture of any monies paid, including the Service Provider’s non-refundable service fee.

 

5.0    Travel Documents, Health, and Entry Requirements

  • Fun Malaysia or the Service Provider shall not be liable for any loss or expense incurred due to the Client's failure to have the proper travel documents, which may result in denied entry.

 

6.0    Travel Insurance

  • The Agency strongly recommends that the Client self-purchased comprehensive travel insurance to protect against unforeseen circumstances, including, but not limited to, trip cancellation, interruption, medical emergencies, and financial default from Service Provider.
  • By declining the purchase of travel insurance, the Client accepts full responsibility for any financial loss or expense that may arise from a travel mishap.

 

7.0    Unforeseen Circumstances

  • The Service Provider assumes no responsibility for and shall not be liable for any claims, losses, damages, costs, or expenses arising out of no-show or injury due to causes beyond its control. This includes, but is not limited to, war, terrorism, civil unrest, labor disputes, mechanical failures, epidemics, pandemics, government restrictions, or extreme weather events.

 

8.0    Governing Law

  • These Terms and Conditions are governed by the laws of Malaysia. Any disputes shall be exclusively resolved by the courts of competent jurisdiction in Malaysia.
